Walking Home For Christmas: Terms and Conditions

1. DEFINITIONS

1.1 To make these Terms easier to understand, they contain some defined terms. These defined terms are set out in the table below and if you see one of these terms used in these Terms, it will be given the exact meaning as set out below.

Application means the online application completed by you to apply to enter the Event;
Children means any participant who is aged under 18;
Event means our Walking Home for Christmas event, the details of which are set out on our Website;
Rules means the rules as set out in section 7;
we, us, our means us, Walking With The Wounded;
Website means our website, a link to which is in section 2.1 (below);
you means you, the person submitting an Application.

2. ABOUT US

2.1 We are WALKING WITH THE WOUNDED, a registered charity. You can find information about us (like our registered charity number and address) on our Website.

2.2 If you need to contact us about anything to do with the Event, you can find details of how to contact us on the Contact Us page of our Website.

3. THESE TERMS

3.1 Please read these Terms carefully; they set out important information about the Event. In particular, by agreeing to these Terms, you will be making some important declarations about:

3.1.1 your fitness to participate in the Event; and

3.1.2 agreeing to comply with the Rules.

4. ENTERING THE EVENT

4.1 To enter the Event, complete the Application by following the onscreen prompts on the Website.

4.2 On receiving your Application, provided it is all in order, we will email to confirm your participation in the Event. It is at the point at which we email you this confirmation that a binding contract will come into existence between us and you which will be subject to these Terms.

5. DECLARATION

5.1 The Event will, depending on what you decide to do, be physically challenging and carries with it risks. Possible risks including:

5.1.1 slips, trips, and falls due to uneven or slippery/icy surfaces;

5.1.2 muscle strain or joint pain from overexertion or poor footwear;

5.1.3 foot injuries such as blisters or stress fractures;

5.1.4 risk of collision with vehicles or bicycles;

5.1.5 exposure to adverse weather conditions (e.g. rain, and cold);

5.1.6 respiratory issues from air pollution;

5.1.7 insect bites or contact with wildlife;

5.1.8 reduced visibility in low-light or foggy conditions;

5.1.9 aggravation of pre-existing medical conditions;

5.1.10 personal safety risks, particularly in isolated or poorly lit areas; and

5.1.11 navigation errors or getting lost in unfamiliar areas.

5.2 By taking part in the Event, you are agreeing that you will not take part if you:

5.2.1 have been advised by a doctor not to take part;

5.2.2 you believe that participating may worsen any existing medical condition(s);

5.2.3 are under the influence of alcohol or any illegal drugs; or

5.2.4 are under the influence of medication (prescription or non-prescription medication) which could have side effects which could be triggered by exertion, or otherwise which may affect your ability to safely participate.

5.3 You understand and agree that:

5.3.1 we are not qualified to express an opinion that you are fit to safely participate in the Event and that you must take appropriate medical advice before participating; and

5.3.2 in the absence of any:

5.3.2.1 negligence (i.e., where we have a duty of care in respect of you, and breach that duty); or

5.3.2.2 breach of any other legal duty,

your participation in the Event is entirely at your risk.

5.4 As your participation in the Event is entirely at your own risk, we strongly recommend that you take out an appropriate policy of insurance to cover any costs or losses which you could incur or suffer associated with the Event.

6. YOUR AGREEMENT WITH US

6.1 By signing up to the Event, you agree:

6.1.1 to walk or run a route of your choice anywhere in the world to raise funds for our programmes which support ex-military personnel and their families;

6.1.2 that the Event is exclusively a fundraising activity for us and not for any other charity or cause; and

6.1.3 in completing the Event, comply with the Rules.

7. RULES

7.1 In participating in the Event, you agree that you will

7.1.1 be a good ambassador for us before, during and after your chosen activity;

7.1.2 acknowledge that the Event is organised us in order to raise funds to support those who served in the UK armed forces;

7.1.3 comply with the requirements relating to fundraising and the money you raise as set out in section 8 (below);

7.1.4 ensure you wear the proper clothing (including waterproofs) and footwear for your chosen activity;

7.1.5 if undertaking your activity during the hours of darkness, wear hi-vis clothing and have a torch;

7.1.6 be respectful of people living in the area in which you are completing your activity and keep noise to a minimum;

7.1.7 if you end your activity at a pub, drink responsibility and do not drink and drive; and

7.1.8 ensure any participating Children are at all times appropriately supervised by their parent(s) or guardian, or someone authorised by their parent(s) or guardian.

8. FUNDRAISING

8.1 You agree:

8.1.1 to deliver all money you raise directly to us by the methods stipulated on the Website within a month of completing your activity, or by the end of 31 January 2026;

8.1.2 that no funds raised will be paid to any charity or other cause other than us (unless we give you our prior written consent); and

8.1.3 only to use lawful means to fundraise for us and not to bring our name into disrepute or otherwise do anything which could damage our reputation.

8.2 You agree not to:

8.2.1 raise funds by carrying out house-to-house collections;

8.2.2 use any form of pressure to get people to donate, or

8.2.3 collect funds:

8.2.3.1 in any public place without first obtaining a collector’s licence from the appropriate local authority;

8.2.3.2 on private property (including shops, pubs etc.) without first obtaining the permission of the owner; or

8.2.3.3 via the shaking of collection tins or buckets (this is illegal); and

8.2.4 organise any raffle or lottery without our prior written consent.

8.3 If you have received money from sponsors, but you don’t complete your chosen activity, you should check with your sponsors whether they would like their money back. If they do, you must return it to them.

9. OUR LIABILITY TO YOU

9.1 We’re responsible for losses you suffer caused by us breaking this contract unless the loss is:

9.1.1 unexpected, i.e., it was not obvious that it would happen and nothing you said to us before we accepted your Application meant we should have expected it (so, in the law, the loss was unforeseeable);

9.1.2 avoidable, i.e., something you could have avoided by taking reasonable action, including any instructions issued by us; or

9.1.3 a business loss., i.e., it relates to your entry into the contract for the purposes of your trade, business, craft or profession.

10. PERSONAL DATA

10.1 By registering for this event, you acknowledge and agree that we will look after and use your data as outlined in our Privacy Policy.

11. COMPLAINTS AND DISPUTES

11.1 If you have a complaint about the Event, please raise this with us directly in the first instances by emailing complaints@wwtw.org.uk. We will do our best to resolve your complaint as soon as we can. We will attempt to resolve your complaint in accordance with our Complaints Policy.

11.2 These Terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

12. OTHER IMPORTANT TERMS

12.1 This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

12.2 If a court or other authority decides that some of these Terms are unlawful, the rest will continue to apply.

12.3 We might not immediately enforce any of our rights under the contract. However, this does not mean we can’t enforce any of our rights at a later date.
